COURT STRIKES OUT JIMI LAWAL’s APPLICATION FOR WRIT OF MANDAMUS ON ILLEGAL PRIMARY

The Federal high Court sitting in Abeokuta on Thursday, 3rd November, 2022 struck out an application for a writ of mandamus in Suit No: FHC/AB/CS/222/2022 filed by Taiwo Olabode Idris and Others (Jimi LAWAL’s cohorts) against Independent National Electoral Commission.

The applicants asked the court for leave to apply for issuance of a Writ of Mandamus to compel the Independent National Electoral Commission to publish Jimi Lawal’s name as the Governorship candidate of PDP.

Mr Thaddeus Idehen of Messer’s Kemi Pinhero appeared for the Applicant; Mr. Damiloju Damilola appeared for INEC and Dr Hassan Balogun appeared for PDP and Hon. Oladipupo Adebutu.

PDP and Hon Adebutu’s counsel applied for joinder and also for the striking out of the suit which were mentioned at the sitting.

Dr Hassan referred the court to the pending appeals at the court of Appeal, Ibadan which has been slatted for hearing on the 14th of this month, and the pending suit in FHC/AB/ CS/ 220/2022; PDP and Hon Adebutu V. Mr. Jimi Lawal and others in which PDP and Hon Adebutu challenged the purported rerun Governorship primary Election in Ogun State.

The court held that since the above cases are still pending, the application for mandamus of Jimi Lawal and co is premature and an abuse of court process.

The matter was struck out with no order as to cost.
